Does any one ever read the 16 page ship contract?

Does any one ever read the 16 page ship contract  that’s sent few weeks before the cruise . I want every cruiser to read & comprehension of that shipping contract. You must agree or you cannot get your boarding passes & Luggage tags , U give up all your rights , They can do anything they want with all your information. U cannot Sue or be in any class action litigation with the cruise company U Agreed.  Don’t push Agree. Till You Read it

@Bob L I do typically read the information I'm supposed to before traveling. It's all a part of your booking information. You don't necessarily give up any rights, but you are agreeing to some things on behalf of the cruise line to ensure guest safety and security for all onboard. You have to agree to the terms and conditions of cruising if you want to cruise. Most of those cruise agreements don't feel wrongful in any way to me. If you don't want to consent to the terms of cruising, you probably shouldn't cruise. There shouldn't be a need for a class action litigation. I have been on many cruises, and agreeing to these policies has never been an issue for me.

I have not read the 16 page contract and my area of practice is not in maritime law which has many unique areas however, In simplest terms, an individual cannot sign away their rights. Of course, the reality is a lot more complicated. 

I suspect CCL contract contains several key areas i.e. exculpatory clauses, Limitations of liability provisions, notice and filing requirements for injury claims, specific procedures or formalities for filing  injury claims, forum selection clauses, and choice of law clauses.

While cruise ship ticket contracts may contain provisions that limit passengers' rights to sue, there are exceptions that may allow lawsuits to proceed. These include:

When the cruise line conduct can be proven to be gross negligence. Gross negligence refers to a level of negligence that goes beyond mere carelessness or ordinary negligence, demonstrating a reckless disregard for the safety and well-being of passengers. In cases where passengers can establish gross negligence on the part of the cruise line, contractual limitations on liability may be overridden, allowing for legal action and potential compensation.

When the cruise lines conduct can be proven to have involved willful misconduct - Willful misconduct involves intentional actions or omissions that cause harm to passengers. Similar to gross negligence, establishing willful misconduct on the part of the cruise line may override contractual limitations on liability.

I.juries resultng from inherent shipboard  - While cruise ship ticket contracts often contain provisions aimed at limiting liability for injuries resulting from inherent dangers such as slippery decks, defective equipment, inadequate security measures, or improper maintenance, there are circumstances where passengers may still have grounds for a lawsuit. For example, if the cruise line fails to take reasonable steps to warn passengers about known dangers or to remedy hazardous conditions promptly, they may be held liable for resulting injuries.

You are so right!  There is a paragraph or so in there that states anyone with any mental ailment can't cruise.  This would mean people with PTSD.  The heroes lounges are full of Vets with PTSD.  It is something I have been concerned about for a few years and have wondered if I might have it.  I have confided in my doctor, but have had no symptoms or triggers until a cruise I took in Europe.  I was found sitting on the balcony crying after calling the clinic for help.  The quacker (doesn't even deserve to be called a doctor) said he thought my drink had been poisoned, and he made some inappropriate assumptions.  No tests!  I questioned his ethics and training.  He was furious. He then put me under cabin arrest for 48 hours, kicked me off the ship and had the Captain ban me...........in a foreign country.  I will never know what happened, and I don't remember too much.  There was a trigger.  A drunk man in the casino gave me a high five and nearly broke my hand. My hand was black and blue and the medics checked it out and gave me a bucket of ice. He scared me, and I lost sleep for two nights.  Since I did have the exact symptoms as someone that has had a laced drink and someone that had a PTSD moment I suspect it was one of the two.  The doctor threatened me, so I called the US Embassy to help get me safely off the ship.  I was taken off the ship minus a diamond necklace I never take off.  I have filed reports with the FBI, Dept. of Transportation and Maritime.  BUYER BEWARE......if you suffer from depression, anxiety, PTSD, bipolar/schizophrenia and have an episode on the ship the contract allows you to be removed from the ship at anytime and anywhere.
